NEC Panelboard Installation Violation

There is a flushmount panelboard that is fed from above by a PVC conduit. The conduit drops down inside the wall to within about 12 inches of the panelboard but does not extend all the way to the panelboard. The wires (THHN) run into the top of the panel at this point and terminate onto the main lugs. I would not have even seen this except that the sheet rock above the panel has been cut away. I believe this is a code violation for two reasons:
1) because the wires are not protected from damage
2) because the panel needs to have a bushing to protect the cable from the enclosure itself.

Does anyone know the actual code violation or if it is not a violation why?

300.3(A) requires that single conductors be installed as part of a recognized wiring method, such as a PVC raceway in accordance with Article 352.

352.30 requires that the PVC conduit be installed as a complete system as provided in 300.18.
