The short circuit and ground fault protection for a 5 hp 1-phase 240V motor based on table 430-52 is 70 amps. The FLA of the motor is based on NEC is 28 amps, can the non-fused disconnect adjacent to the motor be rated a 30amp?

Why you use that table? Why not 430.248 FLA. 28 amps.
You should be wiring 125% of the FLC showing in the table.
Short circuit and ground fault. 250% (NEC)
Wire size. 125% of the FLC (NEC)
OP 115% of the FLA showing on the name_plate of the motor

if that question is directed at me, 430.110 is not a table, it is the section that provides for rating of the motor disconnect means, which I believe was what the OP's post referenced. 430.110 provides that the disconnect must have a rating of 1.15% of the FLA and proper horsepower rating, which the 30 amp NF switch has neither.
