In our jurisdiction it has been allowed to follow 2008 code before it was officially adopted by the State but you can not "pick and choose" parts of each code cycle. All or nothing.

The OP is from NY. NY does not permit the use of the '08 code in general.



the question came up because an inspector fail a pool inspection because "pool water bonding" done at the skimmer

I am not sure if this inspection you speak of is in Westchester or Conn.

If it is in Westchester, it is not a violation. The NEC is a permissive document covering the minimum necessary to have a compliant installation. One is permitted to install work that is 'above' the current codes, as long as not violating the code. Additional bonding of the pool water is not a violation. The product is most likely listed, and going above the minimum requirement in this particular instance is fine.
