i have a problem, we have a 400amp disconnect (service) outside about a 100 feet from
a trought that has two 400 amp main lug only panels. i know you need mains in these panels but i cannot find in the code that sayes this?
any help

You won't find the requirement. If your 400 amp main and the panels are located on the same building, the only limit as to the number of 400 amp rated panels you connect to the feeder is the calculated load.
If the feeder conductor to each panel is rated 400 amp, the scenario you describe is Code compliant.

I agree, no violation. The 400 amp disconnect provides the required disconnecting means for the service.

Mains in the panels would be nice so you could shut one down one panel without killing the whole service to the building, but that's only a design choice.

i looked at 308.36 i read it to say a panelboard shall be protected
we have two 400amp panels.

probably 408.36 and they are protected. 400 amp panels, 400 amp protection. Note that the requirement states the OCP can be located at any point on the supply side.
