Not here in VA. If the bathroom has a window bigger that XXX sq inches? YOu don't need a fan.

IRC Section 303.3 covers bathroom ventilation. If you have a window with an openable area of at least 1.5 sq. ft., you don't need a fan. This would be true in any jurisdiction that has adopted the IRC without amending Section 303.3. Many local and state residential codes, though called something else, are actually the IRC with a bunch of amendments.

ok, so......... i have a 3 switches (1 for a fan, 1 for recessed lights,1 for shower light) that can be reached while sitting in a 'sitting tub'..........This is not a code violation...correct

That is correct as long as it is not in the tub area.
