My bet is they use the same yoke for all switches simply to reduce production costs.
As of now, there is no law that prevents you from ignoring it ;)

I agree. P&S does have yokes on some of their devices with Top writen on them but they state in their info that it doesn't matter how they are installed.

If I recall correctly, Leviton used to use the same yoke for all of their Decora devices. Even the receptacles had "top" printed on them. By the way, that resulted in a "ground down" installation...
