OSHA requiring listed control panel

Some time ago, someone posted a link to a letter from OSHA that appeared to required listing of control panels. I lost the link. Can someone please post it?

I don?t know of a letter specific to control panels, but see FedOSHA?s definition of acceptable in
29CFR1910.399 and the definition of approved in the same Section.

The definition of approved specifies who the AHJ is. (the Assistant Secretary of Labor for Occupational Safety and Health)

The definition of acceptable creates a three tier approach; essentially:

1. If something can be NRTL certified, it must be.
2. If it is of a class where no NRTL certifies such a product (only if 1. above doesn?t apply), a qualified Federal, State or local agency may certify it.
3. If it is so customized that 2. above can't apply, the product may be certified by the manufacturer or the employer based on documented evaluations acceptable to the Assistant Secretary of Labor for Occupational Safety and Health.
