What article states that receptacles in a dwelling shall be of the tamper resistant type? What about dare care facilities? Are they required to have tamper resistant type receptacles? The only place I could locate anything about tamper resistant receptacles is in 517.18 C. Pediatric Locations.

406.12 Tamper-Resistant Receptacles for Dwelling Units
In all areas specified in 210.52, all nonlocking-type 125-volt, 15- and 20-ampere receptacles shall be listed tamper resistant receptacles.

Some exceptions do apply.

If the day care is a dwelling then it is required. If the day care is in a commercial office then I don't think so. But it is a good idea.

The daycare's Insurance Company will often require tamper-resistant even if under the NEC standard receptacles are grandfathered.

If I were wiring a child care location (center, church nursery, low grades in a school, pediatric hospital spaces) and not allowed to put in tamper-resistant receptacles, I would walk away from the job. I don't do dwellings, but if I did the same would apply to them.

see 406.4(D)(5), 406.12, 406.13, 406.14, & 517.18(C).
