Open top fixture in the bathroom - not within the plane that extends up from the tub edge, though still close. No GFCI protection. Shouldn't this be at least an enclosed fixture? DSCF9194.jpg

I reckon that's one of those racoon alert devices for scaring the critters when they get in your house. Light goes on, AND motion sensor activates the valve flow switch and douses 'em. Of course they just head to the kitchen and raid the refer anyway.

Does the listing show damp location and not subject to shower spray ? If so, then it is compliant

Was referring to the OP.

IMO anyone wanting to stand in a tub filled with water able to touch the fixture such as Dennis's picture may have issues. Really the only time they most likely are to be energized is when the tub is being used. Would you feel comfortable letting your children use the tub. I'm not sure the tub wall mounts are damp rated.

The shower with the wet location fixture could be considered a pendant type off the base plate, If not, then use wet location lamps & lose the motion detector for compliance. Also something not recommended IMO.
