SER used underground

I just failed a job because the EC ran SER in a two inch sleve underground.
Now he wants to pull it out and take the sheeth off and re-run the cable with an insulated grounding conductor.
His premis is that the cable is XHHW and therefore it can be put back in the PVC.
What do you all think?

I think he should have not told you he was going to strip the cable :D
Based on my seeing conductors marked XHHW, I would accept it.

in the '08 Code it's 310.11 "Marking"

IN '11 I think it's 310.120
