240.9 Thermal Devices.
Thermal relays and other devices not designed to open short circuits or ground faults shall not be used for the protection of conductors against overcurrent due to short circuits or ground faults, but the use of such devices shall be permitted to protect motor branch-circuit conductors from overload if protected in accordance with 430.40.

I guess it would depend on if the relay is designed as an OCPD.

Without trying to read between the lines, if you really mean a SSR then my question is what will you use for a trip-unit? If you are talking about a Solid-State Power Controller that is going to be a very expensive route...for simple control-circuit OCP

You can have any Breaker, Fuse, etc you want in a C1-D1 Enclosure if it and the installation complies with Art 501. Your choice of OCP (and method for installation) for C1-D1/D2 is going to have to comply with 501.115
