Feeder Tap Grounding conductor size

I have a 350 kcmil tap connected to a bus protected by an 800 amp circuit breaker. The 350's terminate in a 200 amp circuit breaker less than 25 feet away. I feel the grounding conductor should be a minimum 1/0 per 2002 NEC Table 250.122. Am I correct?
The argument presented is that the 200 amp circuit breaker down stream of the tap only requires that a #6 be provided along with the 350 kcmil conductors. (We agree that from the 200 CB downstream a #6 is appropriate.) My argument is that equipment ground for the tap is to be sized per the OCPD ahead of the tapped feeder.

You would size it per the 800 amp device upstream via Table 250.122. If there is a ground fault, the downstream device will never even see the fault.
