I looked at the definition of a Kitchen in the 2011 NEC. I have a "Kitchenette" that we are doing in a basement and the guys only pulled the 2 SABC for the countertop. They are feeding the Garbage Disposal off one of them. This Kitchenette is really small and just has a sink, counter space and a refrigerator. It has no cook top or oven.

I'm trying to see if it really qualifies as a Kitchen and subject to the 2 SABC....:?

'You' called it a "Kitchenette" sooooooo-

noun

1.a small kitchen or part of a room equipped as a kitchen.

Kitchen. An area with a sink and permanent provisions for
food preparation and cooking.

(3) Kitchen Receptacle Requirements. Receptacles installed
in a kitchen to serve countertop surfaces shall be
supplied by not fewer than two small-appliance branch circuits,
either or both of which shall also be permitted to supply
receptacle outlets in the same kitchen and in other rooms
specified in 210.52(B)(1). Additional small-appliance branch
circuits shall be permitted to supply receptacle outlets in the
kitchen and other rooms specified in 210.52(B)(1). No smallappliance
branch circuit shall serve more than one kitchen.

(C) Countertops. In kitchens, pantries, breakfast rooms,
dining rooms, and similar areas of dwelling units, receptacle
outlets for countertop spaces shall be installed in accordance
with 210.52(C)(1) through (C)(5).

Which code governs the identification of space(s) ?.....It is the IRC, and
not the NEC !

From the `12 IRC, Ch. 2 - Definitions: "
KITCHEN - Kitchen shall mean
an area used, or designated to be used, for the preparation of food."

The OP has a sink, ...counter tops, ...a refrigerator and a Garbage Disposal.
IMO, ...this description screams food preparation ! :eek:hmy:

All that tells me is that someone likes to make lots of drinks. Lemons and limes smell great in the disposal.

Arguable. The NEC defines kitchen in article 100, as follows:
Kitchen. An area with a sink and permanent provisions for food preparation and cooking.
That means to me that as that word is used in later articles, that is the definition that must be used.
If the NEC is adopted by reference through adopting the IRC, then you might be able to argue that the IRC definition should be applied to both. But I do not see any fundamental conflict between the provisions of the NEC about requirements for kitchens and the IRC provisions for kitchens.
As a result, the concept of "scope", familiar to programmers, should be applied. Within the NEC, the NEC's definition holds. When you leave the NEC, the IRC definition comes back into play.

Anyway, the inspector did not see it as a kitchen.
Oh, and by the way, I am pretty sure that the rental codes require a provision for cooking food, not just preparing it, to make a unit habitable. Whether that is done just by requiring a "kitchen" or by listing specific functions that must be supported, I do not know.

But the IRC also has this definition:

DWELLING UNIT. A single unit providing complete independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation

Again probably because it didn't have permanent provisions for cooking.

The OP basically told us it was a kitchen then was glad when it was not called a kitchen.

So was it redefined as a bar?

Which is it? :slaphead:

Ohio (RCO -IRC based) and the NEC falls under the building code.

KITCHEN. Kitchen shall mean an area used, or designated to be used, for the
preparation of food.

That is not the nec definition. If you use the nec then it is not a kitchen.
