It is a detached structure from the house. It is not being used as a living space. It can be a garage, work shop, office, storage shed, pool house ........... it can be used for any purpose except as as a living space that happens to have a bathroom.

This space is not a dwelling unit, dormitory or guest room/ guest suite. Nothing prohibits the OP's situation. Just because the property has a dwelling unit on it does not make all of the property a dwelling unit.

True, but sometimes we want it both ways. Can you use exposed NM cable in that detached building without a 15 minute flash barrier? Most inspectors let you do that if it was on residential property, but the code did not. Finally the code was modified to explicitly allow this. There are probably other things only allowed in dwellings that we'd want to be able to do in an accessory building too, I just can't think of any more...

I'd check your local authorities to see how they treat accessory buildings to dwellings. However, I don't know why the code would be OK with a panel in a commercial bathroom, but not a residential one.
