wall penetration for pool sub panel

I need a little clarity I have a NM coming through a brick wall 1 story residential in to The back knockout of a sub panel with NM, kicker for a pool pump "430.109 hardwired motor" does NEC 334.10 nec 2011 allow this wall penetration with no conduit?

Personally, if i was the inspector i dont see how this could be subject to damage unless maybe a sinkhole formed under the house

So you're feeding the exterior surface mounted subpanel with NM cable entering directly into the back? Sounds fine to me, no different than entering the back of an FS box.
