Change the main breaker to 40amp?

I have an apartment panel thats tapped from a main riser with 5’ of 6awg wire run thru a chase nipple. It contains 100 amp main breaker. Does the main breaker need to be changed? The main riser is protected by 100 amp fuses. Load calc for apartment is small (lets say 40 amps).

yes you have a feeder tap so the taps need to terminate on a breaker protecting them at their ampacity. 408.36 also frequently comes into play with these situations, but you are good with that.

edit: It could be 60A though, assuming CU.
