406.3D vs 406.11

406.3D says you can replace like for like. 406.11 says it must be tamper proof. a inspector told me i can apply 406.3D. in other words if they do a kitchen remodel and they put in a new backsplash i can remove the existing gfi and reinstall them. he said i do not have to apply 406.11
 
i was under the impression that any receptacle that was replaced must be tamper proof?

I read it as like can be replaced with like, but (for example) in terms of an ungrounded receptacle being replaced with an ungrounded receptacle and on top of that it has to be tamper proof. The inspector is choosing to waive the requirement.
