Fire rated recess cans

I am used to IC. And non IC recessed cans based on insulation and location of can. I have a building inspector....not electrical...telling me the cans are no good need to be fire rated. They are in a mixed use 2 story building. First floor retail space 2nd floor apartment. The cans are in a bath on first floor. Bath as in toilet and sink. No insulation between 1st and 2nd floor.
Input? Help?

The inspector is right.
You are installing non-rated cans in a fire rated ceiling assembly.
Your plans should have called for rated cans or all surface mounted fixtures.
Check the plans and ask your architect.

or somehow provide proper rating between the can and the other occupancy

You can use sheetrock, tape and mud and build a box around the can. Of course the sheetrock box will be larger than the actual dimensions of the can.

Thanks for the help. Myself or the general contractor have never heard of this fire rated can. Guess you can always learn something. Thanks again
I dont think you can find a fire rated can. You have to put it in a fire rated enclosure of some sort (as mentioned above)
