As so I. IF the building inspector has them seal off the opening at the top of the wall (make a fire stop) do you feel it would comply with 334 as it would have a 15 min barrier although it's in a cavity ?

I think you have satisfied the code wording with the top filled however I am not sure that is the intent. That area can still spread fire rather quickly

He may require more than just the top fire stopped, that said if it meets the fire rating requirements of the building code (which are higher ie. blocking at XX ft. etc.) then I say it is not an electrical concern any more.
