I think I didnt explain myself correctly,,,
the loadcenter for the homeowner of a multy family house,,,
only has the loads for common area lighting,,, hallways and extiror lighting,,,
why should that load center be rated 100amp min,, or 60 amp min for that matter

In a muiti family I see 60s quite often.

In fact, in one local city, it is a requirement. You also must sign an affadavit (issued by the city) stating that you will not use the landlord panel for an illegal apartment. This is why they limit it to a 60 (although a 60 is more than adequate for a small apartment!)

The landlord must sign the paper. Otherwise, they don't get a meter.

I seem to recall something similar going on out San Francisco, as well.
Has there been a big problem with using the house panel/meter for another apartment?

Yes, definitely. But if they don't get the house meter, they'll just tap the illegal apartment off of a tenant panel. Usually the tenant paying that bill doesn't have a clue. I see common area lights, coin operated laundry, etc tapped off of tenant panels all the time.

There just aren't enough inspectors and hours in the day to catch the problems.
