Default Checking Customer Credit

I am being told by people in the legal, credit and collection business that it is illegal to check anyone's (company's) credit without their filling out a credit application prior to a credit check. I find this hard to believe, particularly when working for corporate clients who wouldn't dream of filling out credit apps with a small company such as mine. Does anyone else have this problem, or am I getting wrong advise. BTW, I am in Massachusetts. Maybe it's just the way it is up here.

Try asking your supplier to run a D&B report for you.
