Attached garage panel and Electric Car Charging

Hi.. I'm in the process of purchasing an Electric Car and wanted to ask if my existing garage sub panel is ok for the new 32A charging EVSE?

The EVSE is the device that uses the SAE J1772 coupler to and Electric Car and charges it at night. It requires 230x32=7360VA.

I currently have a Square D HOMC12UC sub panel in my garage which is fed from a 50A breaker in my home panel. It currently has 16 outlets fed by 1 15A and 3 20A breakers on branch circuits. There is also 1 garage door opener rarely used. Each section of he garage has 3 Fluorescent fixtures plugged into 3 switched outlets. There are no other full time appliances. I occasionally use the outlets for power tools but only one at a time. So the 50A fed panel is very lightly used.

The panel has 12 breaker positions with only 4 used. Can I simply add a 40A breaker with #8AWG THHN wire to the EVSE in EMT conduit without exceeding the NEC garage panel sizing requirements. I found it difficult to find the specific requirements for this case in the NEC.

What are the actual sizing rules for a detached garage with no full time appliances.
