No, not really, the existing service disconnect has to disappear or become a feeder disconnect.

Any GEC running to it will have to be moved to the new service rated transfer switch. Any enclosure to neutral bonds will have to be removed. The Grounded and Grounding conductors will have to be isolated from each other.

But the disconnect in a service-rated T/S is upstream of the transfer mechanism itself, so even though they share an enclosure, the disco is still upstream of the T/S.

It's a discussion of semantics, yes, but that happens a lot here. A whole lot.

Exactly, that is what would have to be done. That is the answer to the question.
 
Generally, the answer is no based on NEC 230.82, but, ATS can be connected ahead of the service disconnect if the ATS is rated as service equipment and the connection/bonding of the grounded service conductors, equipment grounding conductors and grounding electrode conductors shall be remove from the existing service disconnect and move to the ATS. The existing service disconnect should be treated as feeder disconnect.

Providing the ats has a main breaker in it.

If you need to do that you must use a service rated transfer switch which becomes the service disconnect.

That is the best answer yet, and the only right one I can think of.

Actually, Generac has a new switch out that has the main service disconnect breaker but removed the genset breaker. Still SE rated.
