Service Entrance Rated 4-Pole ATS & Neutral / Ground Bonding Code Violation?

We have a project where we designed a generator and service entrance ATS for a commercial building. Due to supply issues, the EC can only get a 4-pole SER ATS (with 1000A, 120/208V, 3P main circuit breaker). So that would create a separately derived system, requiring the generator to have a neutral to ground bonding jumper. My question is, does this create a code violation because the SER ATS also has a neutral to ground bonding jumper, or does switching the neutral break that bonding?

Augie, that was actually my suggestion as well, but done by the vendor/manufacturer and not the EC. He is looking into it with them, and I am sure they can do it. But if they can't, it goes back to my original question.

With a switched neutral you need to bond neutral to ground at both sources.
I would not do this in the ATS. Bond in the generator and at the service disconnect.
Also is GFI protection required for 1000 amps @ 120/208?
