I have a 240V 30A circuit that I would like to use for a Level 2 charger. Can I size the OCPD (125%) at 40A and the wire at h125%) #8 so the available load is 30A?

Level-2 max is 40A continuous.
NFPA-70 §110.3(B) prohibits violating listed nameplate. Fuse must match Max load.
Not allowed to put oversized load on undersized wire or fuse, regardless of listed adapters, or adjustable load settings.

Unless either EV or Charger nameplate (appliance) is listed for something less, such as max 30A apparent-power output.

Lacking permit & inspection is a different matter, when real estate listings will include description of car charger as a selling point, and title company can't find that feature listed with original construction, or any such permits on record for that alteration.

Owners may beg for code violations, some can't care less about potential liability, and may even lie to protect you, but banks, insurance, and other inherited interests can squeeze them enough to cough you up.
