Instantaneous circuit breaker as disconnecting means

Would an instantaneous circuit breaker in a listed combination starter be considered a motor disconnecting means and thus apply to 430.110 which states that the ampere rating of the disconnecing means must be at minimum of 115% of motor FLA? Would this therefore mandate that the instantaneous breaker must have an ampere rating of at least 115% of motor FLA with adjustable settings up to that allowed by 430.52?

Yes, in a "listed combination starter" the breaker will be properly sized as such by the manufacturer for the maximum HP as stated on the combo starter nameplate.
