225.36 & service equipment definition

I'm probably splitting hairs here. I have a generator, ats, fusible service switch all more than 50' from a building. I need the disconnect specified by 225.31 and 225.36. all references are NEC2008. defiinition of service equipment contains test "usually consisting of a circuit breaker . . . . ".

In my application where I have either the service disconnect or generator breaker providing the overcurrent protection, can I simply install a switch without fuses as the building disconnect. design included mcb panelboard but mlo panelboard has already been ordered.

must service equipment (not service entrance rated) contain overcurrent protection?

The service disconnecting means must either have integral or immediately-adjacent overcurrent protection (OCP).

The disconnecting means for a building supplied by a feeder is not required to have OCP either integral or adjacent provided both the line and load conductors are protected by compliant means located elsewhere.
