Do ESS systems have to comply with NEC 2014 705.12(D)(3)?

This is related to whether a gfci feeder breaker is suitable for back feeding, not the main.

First, 705.12(D)(3) has nothing to do per se with backfeeding the grid. As long as you have a primary source and another source, this section applies. Think about it: the overload concern that this section addresses applies precisely when the interactive source output isn't backfeeding the grid because the load is consuming all of it plus more from the utility.

Second, ESS systems certainly can feed back to the grid, so I think you'd have get the AHJ to approve that it doesn't in order to even begin to make any argument along these lines, for any part of 705.
