Single family home to assist living

I have single family residential home and now its going to be 8 people assisted living home. AHJ where this work is to be constructed considers anything above 4 people assisted living as commericial. The pronblem is the house is already wired as residential and has romex thru out. Would code allow romex in commercial building such as the single family commericial home mentioned above?

See 334.10 and 334.12. there is no general prohibition from using ramen in "commercial" buildings. Generally it just can't be exposed, nor exposed above drop ceilings. If it's a larger building, don't forget the restrictions in places of assembly (article 518).

As far as NEC goes, does it still fit the definition of "dwelling unit" or "dwelling, one-family"? There are "dwelling units within some "non residential" buildings, whether NM cable is allowed or not is dependent on construction methods and other conditions and as mentioned what is says about those conditions in 334.10 and 334.12.

Its eight bedrooms with one kitchen, bath. Each bedroom has elderly customer living. Construction Type is 5B Not Protected, Use Group is R-4 but AHJ considers above 4 assisted living commericial not residential.

Not sure if this is multifamily dewelling or dewelling but it has romex as branch circuit wiring. Not sure if this would be ok?

Romex is allowed in this type of building whether it is a single family (R3 use group) or R4. The change of use from a Building Code perspective could have a lot of implications. It will need to meet IBC code as opposed to IRC. (Assuming jurisdiction has adopeted ICC codes)

Dont follow change of use from Building Code perspective. Are you saying now that it is considered commericial Romex would no longer be allowed wvwn though its Construction type 5B Not Protected? If not then not sure what you mean?

did they get a zoning change - it is no longer considered residential property?

sounds to me like it is still basically a single family dwelling when it comes to design of it. If each occupant had their own cooking and sanitation provisions then it is no longer single family dwelling.
