One of my customers is under the gun withn OSHA. OSHA says they cannot do this because the boxes are not listed for this application. OSHA is citing

1910.303(b)(2)
Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling.

This has been installed since 1997, which in our case was under the 1993 NEC. I have not been able to find anything that states you can or cannot do this.
Any help is appreciated. One member sent me an 87 page OSHA brief last year. It was helpful in addressing "grandfathering." Thanks!

First I doubt that the picture is from a 1997 installation. I don't think boxes with a raised dimple for the grounding screw were on the market then. Even if the picture is from a 1997 installation, it was a code violation. The rule in 370-23(g)(1) of the 1996 NEC required that a box supported by a cord have a "strain-relief connector threaded into a box with a hub." The same wording appears in 314.23(H)(1) of the 2008 NEC.
 
This box was replaced. You will also note the Woodhead box in the background.
I'm now looking for the exact verbage in 1993. That was the code that was in effect at the time of original install.
I think its the same 370.23. I havea handbook but without the articles.

In the 1993 NEC this requirement is located in 370-23(g).

Here is what it says:

Pendant Boxes. Boxes shall be supported from a multiconductor cord or cable in an approved manner that protects the conductors against strain, such as a strain relief connector threaded into a box with a hub.
