It's a switch, unless the AHJ can make a stand on head dissipation, don't see where he has a leg to stand on. Call the manufacturer of the ATS and have them fax a copy to you of something saying you can do this {makes it a 110.3(B)}.

I always assumed that if it were just splicing the 75% is however much will fit within reason into the box/area that remains. Sounds like the AHJ is is inspecting on how he feels, not what the law says.

Part 2 is it worth if it you win the battle, but lose a war? Battles have to be chosen carefully against future activities...
 
Engineers are smart about theory, not code. Drag the inspector to the thread.

If he wants to pay for the change, and it won't look stupid, change it. Sometimes the money gets cheap in comparison. Not like I haven't done it "the stupid way", to keep peace on a project before.
