tap conductor overcurrent protection

Question 1) given:200A feeders (3/0 cu) from 200A MB to tap box/trough feeding #4 tap conductors/100A MB panel with demand load of 80A and feeding #1/0 cu tap conductors/150A MB panel with 145A demand load.
80A + 145A =225A. Engineer shows 200A MB. ??:-?

Question 2) If conduit enters bldg at grade slab (1st floor) and is routed directly up to 2nd floor MB panel, approx 15ft, would it be in violation of NEC 240.21(B)(5)?

As far as question 2, that would be, in my opinion, a violation. I would look to the local AHJ as far as what they do with 230.70(A)(1) and apply the same rule.
