breaker protection

this question may have come up before but it came up in a discussion with some of the electricans i work with.is it a code violation if a existing panel down stream which is a sub panel and happens to have a 400 amp main be protected by a 200 amp breaker located in a service panel in the electrical rm? because a lot of the loads will be elimated. isee no problem with this as long as the wire to the 200 amp breaker is the proper size

No problem-o. You can feed a larger breaker with a smaller wire, so long as the smaller wire is properly protected upstream, and the connected loads are within the range of the feeder.

Also, as long as the smaller wire is sized to carry the amperage likely to be impressed on it.

I do the same thing all the time with smaller panels, 100 amp feeder to a 200 amp main breaker panel, the 200 amp breaker becomes a disconnect switch and the 100 amp is the OCP.
