Protection of circuit

In Mike Holts Understanding The NEC for 2005 refering to Art. 440.21 on page 483-484, figure 440.5-440.6. I see that the 40 amp fuses are installed for the AC unit. What size circuit breaker is feeding the 40 amp fuses? Thank you and have a happy fourth of July.

I do not have that book but I think it is a safe bet the breaker is 40 amps or greater.
 
jj, I'd say Bob has a safe bet.
The air conditioner would need over current protection in accordance with it's nameplate or as determined by Art 440. The fuses COULD porvide this protection or a properly rated "upstream" device could provide the protection in which case the fuses might just be a part of the disconnecting means and would not be relevant as long as they weren't undersized.
