8.5 KW oven/range on 50 amp circuit

Anyone heard of an issue with having a lower wattage range on a branch circuit. The appliance installer claims that this 8.5 KW range cannot be on a 50 amp branch circuit. Says I need to install a 40 amp breaker.

Does the range have a marked overcurrent protection device rating?

Take a look at 422.11(E) for overcurrent protection for a single non-motor operated appliance.

If he can show that to you in written instructions from the manufacturer, he's correct.
 
He may be refering to:
210.19(A)(3) Household Ranges and Cooking Appliances.
For ranges of 8 3/4 kW or more ratingthe minimum branch-circuit rating shall be 40 amperes.

Notice is states "minimum"

As Chris mentioned, 422.11(E), I will add 422.11(A) as well.

The range receptacle is rated for 50 amps, 120/240v.

So shouldn't the circuit breaker on that circuit be 50a?

Not necessarily.

Take a look at 210.21(B)(1).

A single receptacle installed on an individual branch circuit shall have an ampere rating not less than that of the branch circuit.

So you can put a single 50 amp receptacle on an individual 40 amp branch circuit.
