AHU Disconnect Mounted on the Unit

Per 110.26(A) I am reading that a disconnect that is factory mounted to the AHU still requires the working clearance as stated in 110.26(A).

I wrote up an electrical contractor at a site I walked. The Electrical contractor then wrote an RFI to the Engineer and the engineer said the installation is acceptable per the NEC (But did not give a section).

The clearance currently is 30" and the door opens to about 80 degrees.

Let me know your thoughts on this installation.

As bad as I hate to agree with an inspector:D I think you have them. The engineer may have 110.26 (A) 2 in mind which is working width not depth.
110.26 (A) 1 table has it as 36''. But that 36'' can be from the enclosure.
