Yes, and on 05' you can use 310.15 (b) (6) ,,,,but on 08' you cannot use that chart unless you're sizing a feeder that carries the whole load of the house.

Yes, you need to do a load calculation in accordance with Article 220 and size the panel accordingly.

The 2005 NEC requires these conductors to be the Main Power Feeders to use 310.15(B)(6) table !

Officially you have not been able to use 310.15 (b) (6) for subs for many code cycles, the 2008 has only clarified the existing position.
