Years back when TR's were first required my supplier took back every non TR receptacle I had.

just use them up as replacements in houses that don't have TR. I don't think it really is a big deal to do that. You aren't getting a permit for every receptacle you replace are you? and even though you are supposed to use TR - in order to exhaust current stock - I wouldn't sweat using them up as replacements. depending on how much residential service work you do - it could take a while to use them up.

Thanks for the link, however, I'm looking for a code section along the lines of 406.3(D).
Like replacement receps in 406.3(D)(2) for GFI protection.

NFPA says new construction and renovations would changing an existing outlet fall under renovations?

I think that they SHOULD but that is not how I read:
Ohio (IRC based):
115.2 Maintenance.
Residential buildings, structures and the building equipment shall be maintained in a safe and sanitary condition and in accordance with the condition(s) established in current and any previous plan approvals and certificates of occupancy. Devices or safeguards which are required by this code shall be maintained in conformance with the code edition under which installed. The owner or the owner's designated agent shall be responsible for the maintenance.
So I think that non TR recpts could be used.
115.4 Additions and alterations.
Additions or alterations to residential buildings shall conform to the requirements of the code for new construction and shall be approved by the residential building official. Additions or alterations shall not be made to an existing building or structure which will cause the existing building or structure to be in violation of any provisions of this code. Except as otherwise provided for in Section R313.1.1, portions of the structure not altered and not affected by the alteration are not required to comply with the code requirements for a new structure.
Now for additions or alterations then yes.

I agree on both.
Now, my town is under the '03 IRC, so even appendix J would not apply towards TR receps.
When we adopt the '09 IRC, the AHJ is considering deleting the elec. portion of the IRC due to the state's adoption of the NEC.
That said, I don't believe the NEC requires replacing receps. w/ TR receps.

Nice read, yet not totally accurate. The statistics they use are not reflected accurately, Like they do not display the difference in location for the accidents. Like what is the percentage of children hurt on commercial property VS residential? Then there is the cost issue it is not 50 cents..the true cost is 0.39 vs a 1.19 that is much more then .50 .. I believe there was more political influence then we get to know, like who really benefits from a law like this?? only the manufacturer as they would not sell them other wise. So they lobby to have TR receptacles and walla we all install and the american home owner suffers the loss as TR does not increase the cost of the house. I raised kids and none of them ever had any incident with a electrical receptacle. I can not disagree with the choking hazard but I do not believe it needs to cost so much for TR receptacles ...
I do not believe changing a faulty receptacle means you need to upgrade to TR and I also believe if I extend a circuit I do not have to change every outlet on the circuit but every outlet on the circuit I have to work on does need to be upgraded..
