Commercial range/oven

We have a commercial grade range/oven. We have 208V going to unit. The nameplate says at 208V the unit draws 10.3KW. Thats 49.5A. Do we need to size the breaker at 55 or 60Amps and put in #6 conductor? NEC 220.56-Kitchen Equipment-other than dwelling units says the demand factor is 100%. now, we have someone telling us we are wrong and that we should take the 49.5A, multiply it by 80% which gives us 39.6A and OL should be 40amps.I decided to take this do a forum I trust. That is why I am asking you guys, what is correct?

Please clarify one thing for me. Is this an academic question, something related to the class you are teaching? Or are you talking about something you are planning to install yourself?
