Back feeding breakers for mains

Howdy folks! A lil' help please!
I know that if you backfeed 2pole 60amp 240v (plug in ) Square D breaker and use it for a main in a small load center that a "holding clip" of sorts is required.
I cant seem to locate this rule in the NEC??
Is it a design requirement from the manurfacturer, or a NEC issue?

Did you try NEC 2008 408.36(D)Back fed Devices ??
