Is my company liable?

My office help had to make a trip for office supplies. On the way back to her car she dropped one of the packages. Benidng over to pick it up she heard a whistle, looked to see a guy in a delivery van giving her a smile and a big thumbs up, after which he drove into a light pole. Am I liable?

No, but if she had hurt her back bending over to pick up the package, or was in an accident on the way back (even if in her personal vehicle and on her own lunch time), then yes you would be have some liability.

The answer is that you are liable if the jury says you are.
