Application of Article 409

Article 409, the "SCCR" issue, applies to "Industrial Control Panels" as far as I can tell. But what is being considered an Industrial Control Panel? I have someone building a computer server rack. They are feeding it with 3 phase 4 wire, 480/277 then using the single phase 277V power off of that for the individual power supplies. They have 50kAIC available at the line terminals and are using a 65kAIC 3 phase main CB feeding a system of the UL1077 1 pole "supplementary protectors" rated 10kAIC to distribute that 1 phase power to the PSUs. I said the UL1077 units are insufficient and even if they used UL489 versions, if they are rated 10kAIC, it still won't pass muster by pointing to Article 409. I'm being told it doesn't apply because "this isn't an industrial control panel".

Thoughts?
 
I don't think it is an industrial control panel either.

409.2 Definitions.
Industrial Control Panel. An assembly of a systematic
and standard arrangement of two or more components such
as motor controllers, overload relays, fused disconnect
switches, and circuit breakers and related control devices
such as pushbutton stations, selector switches, timers,
switches, control relays, and the like with associated wiring,
terminal blocks, pilot lights, and similar components.
The industrial control panel does not include the controlled
equipment.

I think you still have to deal with the available short circuit current problem, even if it is not an ICP.
 
Ignore 409 entirely. This code simply makes custom assemblers follow the same rules as UL508A in regards to telling their customer important application information about their equipment.

Rely on 110.9 and 110.10 instead.

Of course without the required 409 labeling how do you know your equipment is being installed per 110.10?
