My answer would be, that if the mounting vertical, the breakers' "up" position must be the "on" position.

I agree with you!!!
Horizontally no problem but up side down ,no way!!!

Not quite sure I understand the installation in this question. I take MCCB to be "motor controlled circuit breaker." But I would ask if the ATS is a manufactured unit, or if it is to be put together in the field. If the former, then the NEC rules would not be relevant.
