Nipples and conduit size

I'm comming off an existing transformer that has a 4 inch nipple to a pull box. I'm going to come of the transformer with two separate feeders both of which will terminate in a CB within 10 feet. The nipple which is about 8 inches may not be sufficiently large such that the fill not exceed 40%.

Do I need to maintain 40% for this very short length of conduit. i.e. for the sake of this 8 inch long nipple?

No. See 310.15(B)(3)(2) for ampacity and Chapter 9 Table 1, Note (4) for fill. You can have 60% fill here.
