sub-panel breaker across from main breaker

If the main panel has a main breaker on the stabs, does code allow a sub-panel breaker across on the same stabs as long as the stab rating is not exceeded?

For example: Main breaker on #2 & #4 and sub-panel breaker on #1 & #3.
 
Some panels in the past have limited the amperage per common stab including breakers across from the main.
I'm not sure if there are in on the market presently that have this limitation.
Zog may know.
