Bar Counter Surface Mounted Receptacles

On a commercial project in NYC, NY a stainless steel surface mounted box (12?L x 4?W x 1.5? H) containing duplex 120V receptacles (not GFI) was installed on the top of a BAR counter top. The box has a hinged cover with a rectangular cutout for the insertion of cord connected appliances, e.g. coffee makers, blenders. The electrical inspector issued a violation of this installation. I do not believe this is a violation and would like your opinion.

..is the outlet within 6' of a sink (210.8(B)(5)?

Did you check NYC code to make sure it's not in there?
