375 amp mainbreaker used as a splitter

I have been asked to assess a 3ph 375 amp 120/208 service that has a number of subpanels the original installation has 3/0 aluminum (185 amp rating) splitting off from the loadside of the 375 amp main breaker to 2 of the subpanels I do not believe that you can split from a breaker and the conductors need to be rated to the breaker size 500MCM copper I believe that there should be a splitter box after the main and then a breaker to protect the subpanel feeders am I right

I don't know Canadian codes but here that might be a legal feeder tap depending on distance and other conditions.

The panels would need over current protection.
