ATS as service disconnect

Sometimes I don't know if I'm the boxer or the bag

Roanoke, VA.
Occupation
Sorta retired........
Kohler KSS 200 amp ATS.
It has a meter socket on the exterior wall nipple through to the ATS and nipples to a 200 amp panel with a main breaker imediately adjacent to it.
Does the ATS need protection in front of it? or is it legal as described?
I'm pretty sure the ATS is not service rated.

Unless the ATS is service rated (if so it will have service a service disconnecting means and OCP) it is a violation to install it ahead of the service disconnect as noted in 230.82

Agree with post#2. We have addressed this several times recently and it looks like we're neighbors. (I have seen ATS rated for services only with additional OCP. See 230.91.)

We see a lot of confusion with ATS installs and grouping of disconnects. Hopefully we are not adding to the confusion.:huh:
