Can high rise loadcenters be tapped (in the gutter) and be Main Lugs Only if the tap conductors are greater than 33% of the riser conductors?

Yes, I agree. He said 33% so I assumed, possibly incorrectly, that the tap was under the 25' rule. Your other code sections would still make this installation non-compliant.
