Service Disconnect - Back Fed Main Circuit Breaker

I have a panel with a back-fed main circuit breaker. Can a back-fed main circuit breaker within a panel be the service entrance disconnect?

230.70 doesn't specify what type of disconnecting means shall be used only where it can be located and that it should be marked. And a back fed breaker meets the requirements of 230.76 as a disconnecting means. So, if it is secured in accordance with 408.36(D) it should be ok.
